Terms of Service
The legal agreement and rules governing your access to and use of CrossLobby and associated services.
1 Agreement, Parties & Eligibility
These Terms of Service constitute a legally binding agreement between you (the "User") and Technomancers (Pty) Ltd ("Technomancers", "we", "our", or "us"), a private company incorporated in the Republic of South Africa.
To use CrossLobby, you must be at least 18 years of age, or have obtained the verifiable consent of a parent or legal guardian. By registering, you warrant that all information supplied is truthful, complete, and accurate.
2 User Accounts & Security Responsibilities
You are responsible for maintaining the confidentiality of your login credentials, including passwords and authentication tokens. Any action performed through your authenticated account is presumed to be authorized by you.
You agree to notify Technomancers immediately at support@mybrews.co.za if you suspect unauthorized access or security compromise of your profile.
3 Code of Conduct & Acceptable Use
CrossLobby thrives as a respectful, passionate community of coffee lovers, baristas, and gamers. When using the application, you agree NOT to:
- Post abusive, defamatory, harassing, sexually explicit, hateful, or discriminatory comments, reviews, or messages.
- Impersonate any person, business, café, roastery, or Technomancers representative.
- Deploy automated scripts, bots, spiders, or scrapers to extract data, spam community feeds, or artificially generate orders.
- Manipulate points, check-ins, ratings, or tournament leaderboards through artificial collusion, location spoofing, or software vulnerabilities.
- Reverse-engineer, decompile, or attempt to derive the source code of the CrossLobby application or API.
4 Marketplace, Roasteries & Café Orders
Platform Intermediary Role: CrossLobby provides the technology platform that connects customers with independent third-party coffee roasteries, cafes, and merchants. Technomancers (Pty) Ltd is not a food or beverage producer.
Merchant Responsibilities: The preparation, quality, packaging, freshness, allergen management, pricing, and fulfillment of coffee and consumables are the exclusive responsibility of the merchant with whom you place your order.
Payments & Refunds: Payments processed via integrated payment channels (including Ozow Instant EFT, Yoco Card Processing, or Brew Points) are authorized at the time of order placement. Inquiries regarding order cancellations or refunds must be addressed directly to the participating merchant in accordance with their store refund policy.
5 Intellectual Property & User Content
Your Content: You retain all intellectual property rights to the reviews, brew logs, tasting notes, photos, and messages you submit. By posting content to CrossLobby, you grant Technomancers (Pty) Ltd a worldwide, non-exclusive, royalty-free license to host, display, adapt, and distribute this content across our services.
Technomancers Intellectual Property: All software code, user interface designs, custom themes, logos, brand names, mascot illustrations, sound designs, and leaderboard algorithms are the exclusive proprietary intellectual property of Technomancers (Pty) Ltd and are protected under South African and international copyright and trademark laws.
6 Account Suspension & Termination
Technomancers reserves the right to suspend, restrict, or permanently terminate your account and forfeit accumulated points or benefits without prior notice if you violate these Terms of Service, engage in fraudulent transactions, or behave abusively towards merchants or community members.
7 Disclaimers & Limitation of Liability
CrossLobby is provided on an "as is" and "as available" basis. To the maximum extent permitted under the South African Consumer Protection Act (CPA), Technomancers (Pty) Ltd disclaims all warranties, express or implied, regarding uninterrupted uptime, café inventory availability, or accuracy of third-party tasting notes.
Technomancers shall not be liable for indirect, incidental, or consequential damages resulting from platform downtime, café service delays, or third-party merchant conduct.
8. Governing Law & South African Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of South Africa.
